TERMS AND CONDITIONS

  1. ENROLLMENT
    1.1
    All enrollment applications to any of our courses, study programs or trainings will be formalized by fully completing the appropriate registration form. Furthermore, all the documentation required for the course, study program or training as specified in their respective description must be delivered accordingly.

    1.2. Once the student has completed the registration form and delivered all the required documentation for the course, study program or training in which they want to take part, if applicable, AC·Xpanish reserves the right to accept or refuse the application.

     

    1.3. Any place in any of our courses, study programs or trainings will be booked once the enrollment process is completed and the corresponding fees for the course, study program or training the student has applied to have been paid.

    1.4. The student agrees to send the payment receipt for the course, study program or training to AC·Xpanish, in case this was made by bank transfer, deposit or any other electronic means of payment that AC·Xpanish accepts.

    1.5. No signature is required to formalize enrollment. The execution of the application process and subsequent payment for the course, study program or training confirm acceptance of AC·Xpanish’s terms and conditions.

  2. COURSES, STUDY PROGRAMS AND TRAININGS

    2.1. All courses, study programs and trainings offered by AC·Xpanish are aimed at non-Spanish speakers over the age of 16.

    2.2.The study programs are taught in one-on-one online and live lessons, grouped into packages of hours per sublevel that must be taken within a certain period of time. These packages of hours are renewable or nonrenewable, depending on the study program. According to the current study programs:

    The Por mi cuenta (On My Own) program comprises a nonrenewable package of 5 (five) hours of private, online and live lessons per sublevel that must be taken within a maximum period of 5 (five) months.

    The Miti Miti (Half & Half) program comprises a nonrenewable package of 15 (fifteen) hours of private, online and live lessons per sublevel that must be taken within a maximum period of 5 (five) months.

    The A mi ritmo (At My Own Pace) program comprises a renewable package of 10 (ten) hours of private, online and live lessons per sublevel that must be taken within a maximum period of 3 (three) months. The package of hours per sublevel may be renewed without limit.

    2.3. In case the student needs additional class hours after completing the Por mi cuenta (On My Own) or Miti Miti (Half & Half) program packages, they may request a maximum of 5 class hours per sublevel and must pay the appropriate fee.

    2.4. In any of these programs, the time period for each student will begin on the day they take the first lesson.

    2.5. In any of the study programs, the dates and times when each lesson of the package will take place must be scheduled on the first day of class.

    2.6. If a student is not satisfied with their teacher for any reason, they may request a change.

    2.7. One-on-one lessons for any study program must take place Monday through Friday, from 8 am to 8 pm (Argentina time zone). Lessons on Saturdays and Sundays and outside the hours specified above are subject to availability, and the prices of the study programs will be increased by 20%.

    2.8. Lessons are 55 minutes’ long.

  3. CANCELLATIONS AND CHANGES
    3.1.
    Any course, study program or training that a student purchases with AC·Xpanish is personal and nontransferable.

    3.2. In the event a student cancels their enrollment in any of our courses, study programs or trainings before the start date, we will retain an amount equal to 15% of the price of the course, as administrative charges. This cancellation must be notified by the student to AC·Xpanish in writing by email.

    3.3. In case a student cancels or opts out of any of our courses, study programs or trainings after the start date, no amount will be reimbursed.

    3.4. If a change is requested regarding the type of course, study program or training for another one with a lower price than the one that was originally chosen, the student will be compensated with additional class hours only, which will be agreed upon with the student and will be subject to availability. Otherwise, the price difference must be paid.

    3.5. In case a student wants to change to a different sublevel, they must request it within the period of time covered by the first two lessons in the Por mi cuenta (On My Own) program and the first three lessons in the Miti Miti (Half & Half) and A mi ritmo (At My Own Pace) programs.

    3.6. AC·Xpanish will not be responsible for cancellations due to force majeure reasons, illness or personal issues on the part of the student. AC·Xpanish reserves the right to analyze each case individually and request submission of specific documents if deemed appropriate in order to decide whether reimbursement applies or not.

  4. HOLIDAYS, NONATTENDANCE, RESCHEDULING AND MAKE-UP CLASSES
    4.1.
    One-on-one lessons coinciding with public holidays in Argentina and in the country where the student is located will be rescheduled to a date and time agreed between both, teacher and student.

    4.2. Rescheduling and make-up classes for one-on-one lessons will only take place in case the student notifies nonattendance to their teacher and the school at least 24 (twenty-four) hours in advance. Otherwise, lessons will neither be reimbursed nor made up.

    4.3. For each one-on-one lesson, there is a tolerance of 10 (ten) minutes. Nevertheless, that time is regarded as part of the lesson and will not be made-up for. Once the tolerance period has elapsed, the teacher will abandon the class and it will be regarded as taught.

    4.4. In case any of the parties involved (teacher and student) suffers any technical contingency such as a loss of power, Internet service outage, etc., before or during the lesson, it will be rescheduled to a date and time agreed by both parties.

  5. PRICING
    5.1. Prices are per student, unless otherwise specified, and are expressed in U.S. dollars. Likewise, they are subject to change without prior notice.

    5.2. Any banking fees or financial charges resulting from payments made by the student to AC·Xpanish will be borne by the student.

  6. DISCOUNTS AND SPECIAL OFFERS
    6.1.
    Any discount or special offer will be applied upon enrollment in a course, study program or training.

    6.2. Discounts or special offers made available after AC·Xpanish receives an application to enroll in any course, study program or training will not apply.

    6.3. Special offers are not cumulative and are subject to availability.

  7. COMPLAINTS AND CLAIMS
    7.1.
    Any complaint regarding a course, study program or training that a student has purchased with AC·Xpanish must be notified in writing, by email, within the first 48 hours or within the period of time covered by the first 3 (three) lessons. Otherwise, the student loses their right to compensation, change or reimbursement.

  8. TRAINING CERTIFICATE
    8.1.
    Once the student has completed any of our courses, study programs or trainings, a digital certificate of attendance and training will be delivered in PDF format. AC·Xpanish will only deliver this document as long as the student has attended, at least, 80% of their lessons. Otherwise, no document will be issued.

    8.2. Any certificates issued by AC·Xpanish to students after they completed any of our courses, study programs or trainings will be digitally stored for a period of 2 (two) years; no claim may be made beyond this period.

    8.3. In the case of loss or misplacement of the certificate for any of our courses, study programs or trainings on the side of the student, within the 2-year period stated above, AC·Xpanish will proceed to issue a new certificate as long as the student has notified AC·Xpanish about the situation in writing, by email, and has paid the appropriate fee beforehand.

  9. INTELLECTUAL PROPERTY RIGHTS
    9.1.
    All content material for each course, study program or training is subject to intellectual property rights belonging to AC·Xpanish or to third parties, as specified in each case.

    9.2. The student may make use of said material, whether it consists in texts, images, videos, activities, exams or any other content being used in the course, study program or training the student is taking, according to their objective and purpose, and the student may also save it, print it and use it for their own exclusive use, unless otherwise specified.

    9.3. It is strictly forbidden to use the contents of the course, study program or training for purposes other than its own, as well as to reproduce, disseminate and publish them. Any intellectual property right infringement will be legally prosecuted.

  10. PROTECTION OF PERSONAL DATA
    10.1.
    Under Act 25.326, the personal data contained in the registration form will be entered into our database to be used for educational, operational, marketing or promotional purposes.

    10.2. Acceptance of these terms and conditions implies consent by the student. Otherwise, the student has the right to access, rectify and cancel any of their personal data pursuant to the applicable laws.

  11. AUTHORIZATION AND DISCLOSURE OF DATA
    11.1
    By formalizing the enrollment process, the student authorizes AC·Xpanish to disclose personal data to companies or entities that assist in offering the course, study program or training they have purchased.

  12. USE OF STUDENTS’ IMAGE
    12.1.
    AC·Xpanish reserves the right to use written, photographic, audio or audiovisual material that has been obtained during the course, study program or training for educational, operational, marketing or promotional purposes, as long as there is no prior and express objection by the student.

  13. LANGUAGES
    13.1.Given the nature of the services provided by AC·Xpanish, a great portion of the information is translated into other languages. There may be errors or misinterpretations in the translated versions, hence the Spanish version is the only one that will be taken into consideration in case of any controversy that may arise between a student and AC·Xpanish.

  14. JURISDICTION
    14.1. It is expressly established that in the face of any discrepancy that may arise regarding the interpretation or application of the terms and conditions for the services above, namely, online and remote courses, study programs and trainings, the legal representative of AC·Xpanish and the student agree to submit matters to the Trial Courts of Río Tercero, Córdoba, Argentina, expressly waiving any other jurisdiction that may apply to them, including the federal jurisdiction.
